Consumer Fireworks Now Legal In Pennsylvania

The state of Pennsylvania has legalized the sale and use of Class C consumer fireworks including Roman candles, aerial cakes, artillery shells, firecrackers, bottle rockets, and more.  Pennsylvanians will now get to celebrate the Fourth of July and New Year's holidays like most other states.  

The bill HB0542 PN2598 passed the General Assembly and signed by Gov. Tom Wolf's.  You can read the details of the bill here.  The consumer fireworks portion starts on page 257.  

This law change is a win for not only the firework consumers of PA, but also for the entrepreneurs in the state who now have a unique opportunity to become one of the first consumer fireworks retailers in their community.    Retailers are looking for locations to stake their claim, wholesale fireworks suppliers are vying to win the business of the new and expanding firework stores.  

Some of the key provisions of the new PA consumer fireworks law:

  • Must be 18 years old to purchase, possess, use consumer fireworks
  • Tax rate for fireworks will be 12% on top of the current 6% tax rate
  • Annual firework retailer license fees will range from $3000 annually for temporary structures to $7500 - $20000 for permanent structures depending on square footage.
